Colossus, Settlements, Litigation and the AMA Guidelines

Published by Kentucky Justice Association
and Canadian Caucus of AAJ
Learning Objectives

  • Understanding AMA Guidelines and how they impact valuation of damages
  • How Colossus uses AMA Guidelines
  • How you can use AMA Guidelines in trial to counter the defense on damages
  • Techniques to increase settlement offers and trial verdicts

Summary

The auto insurance industry has replaced the judgment of medical professionals with claims management software programs such as Colossus that rely on medical records and other data input by the insurance adjuster to calculate the value of your client’s injuries. Any injuries not included in your client’s medical records are not part of the data set for Colossus calculations, leaving your client’s damages undervalued.

Getting your client a fair settlement requires knowing how Colossus uses your client’s medical records to value damages, including  what information is entered into the system, understanding AMA Guidelines and how they are used by Colossus, and knowing how to use AMA Guidelines at trial to counter the defense’s valuation.

Mike Schafer and Jack Sells will use an actual case study to illustrate the workings of computer-driven settlement programs, such as Colossus, including key points that factor into calculating the value placed on your client’s injuries. You will learn how Colossus uses AMA Guidelines in its software algorithms and how you can use those guidelines in trial to counter the defense’s valuation. Using the techniques from this webinar, you can increase both settlements and trial verdicts, getting your clients the justice they deserve.
